These Terms & Conditions ("Terms") govern your access to and use of the TechTvik Labs
website and cloud software platform (the "Service"), operated by TechTvik
("we", "us", "our"). By creating an account, signing in,
or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- You / Lab / Customer — the individual or legal entity that registers for and operates a laboratory account on the Service.
- Authorized Users — lab owners, staff, collection center operators, doctors, and others you permit to access your account.
- Patient Data — personal and health-related information entered, stored, or processed through your account.
- Content — test results, reports, bills, templates, images, and other data you or your users submit to the Service.
2. Nature of the Service
TechTvik Labs is a software-as-a-service (SaaS) platform that provides tools for laboratory operations, including booking, billing, reporting, inventory, notifications, and related features.
We are not a medical laboratory, diagnostic provider, or healthcare professional. We do not perform tests, interpret clinical results, issue medical advice, or make treatment decisions. The Service is a technology tool only.
3. Laboratory Responsibilities
You are solely responsible for all clinical, operational, and legal outcomes arising from your use of the Service, including:
- Accuracy of patient details, test orders, results, calculations, formulas, and reference ranges;
- Review and approval of every report before release to patients, doctors, or third parties;
- Billing amounts, invoices, taxes (including GST), discounts, and financial records;
- Compliance with applicable laws, including diagnostic laboratory regulations, NABL/quality standards (where applicable), and data-protection requirements;
- Obtaining valid patient consent where required for data processing, report sharing, and online lookup features;
- Actions of your staff, collection centers, referral doctors, and anyone using credentials you provide.
Software-generated outputs, templates, and any AI-assisted suggestions (if enabled) are not substitutes
for professional judgment. You must verify all outputs before clinical or commercial use.
4. Account Registration & Security
- You must provide accurate registration information and keep your account details up to date.
- You are responsible for safeguarding login credentials and for all activity under your account.
- You must not share owner-level access with unauthorised persons or use the Service for unlawful purposes.
- We may suspend or restrict accounts that violate these Terms, pose security risks, or remain unpaid after notice.
5. Subscription, Trial & Payments
- Access to paid features requires an active subscription or wallet balance as shown in your plan.
- Free trials, if offered, are provided as-is for evaluation and may be limited in duration or features.
- Subscription fees, recharge amounts, and payment terms are displayed at purchase. Taxes may apply as per law.
- Online patient payments processed through integrated gateways are handled by third-party providers; you are responsible for configuring gateways correctly and reconciling transactions.
- Refund and cancellation terms for subscription payments are described in our Refund Policy. Unless stated otherwise, fees for consumed subscription periods are non-refundable.
6. Acceptable Use
You agree not to:
- Use the Service to upload false, misleading, or unlawful content;
- Attempt to bypass security, access other labs' data, or reverse-engineer the platform;
- Overload, scrape, or automate access in a way that harms Service stability;
- Resell, sublicense, or white-label the Service without our written agreement;
- Use the Service to send spam, abusive messages, or unauthorised marketing via SMS, email, or push notifications.
7. Patient Data & Privacy
- You act as the data controller for Patient Data you enter. We act as a technology processor providing hosting and software tools.
- You must collect, use, store, and share Patient Data lawfully and only for legitimate laboratory purposes.
- Features such as patient report lookup, public lab profiles, and report sharing are disabled by default or controlled by you. You are responsible for what you publish online.
- We implement reasonable technical safeguards, but no system is completely secure. You must maintain your own backups of critical records where required by law.
8. Reports, Integrations & AI Features
- Report templates, PDF layouts, QR links, and digital delivery tools are provided for your convenience. You are responsible for final content.
- Third-party integrations (payment gateways, email, SMS, push notifications) are subject to those providers' terms and availability.
- Where AI-assisted features are offered, they may produce incomplete or incorrect suggestions. You must review all AI output before use. AI features may be enabled, limited, or disabled per account at our discretion.
9. Intellectual Property
- We own the Service, software, branding, documentation, and underlying technology. These Terms do not transfer ownership to you.
- You retain ownership of your Content. You grant us a limited licence to host, process, and display your Content solely to operate the Service.
- You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.
10. Service Availability & Changes
- We strive for reliable uptime but do not guarantee uninterrupted or error-free operation.
- We may update, add, or remove features for maintenance, security, legal, or product reasons.
- Planned maintenance or outages will be communicated where reasonably possible.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.
- We are not liable for clinical errors, misdiagnosis, incorrect reports, billing disputes, regulatory penalties, or patient claims arising from your use of the Service.
- Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim, or INR 5,000, whichever is greater.
Nothing in these Terms limits liability that cannot be excluded under applicable law (including fraud or wilful misconduct).
12. Indemnification
You agree to indemnify and hold harmless TechTvik, its officers, employees, and partners from claims, losses, damages, penalties, and expenses (including reasonable legal fees) arising from your Content, your breach of these Terms, your violation of law, or disputes with patients, doctors, staff, or third parties connected to your laboratory operations.
13. Termination
- You may stop using the Service at any time. Account deletion or data export requests may be submitted to support.
- We may suspend or terminate access for non-payment, breach of Terms, legal requirement, or risk to the platform or other users.
- Upon termination, your right to access the Service ends. Provisions that by nature should survive (liability limits, indemnity, governing law) will remain in effect.
14. Governing Law & Disputes
These Terms are governed by the laws of India. Courts at our principal place of business shall have exclusive jurisdiction, subject to applicable consumer protection laws that may provide otherwise.
15. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date at the top will change when we do. Material changes may be notified via the Service or email. Continued use after changes take effect constitutes acceptance of the revised Terms.
